General Conditions of the Loyalty Club

Article 1 - Preamble
1.1. The Maison du Chocolat, SAS with share capital of € 13,222,470, whose head office is located at 65 avenue de Ségur, 75007 Paris, FRANCE, registered with the RCS of Paris under number 572 154 318 has created and runs a loyalty program for its customers living in Europe called Le Carré des Passionnés® (hereinafter referred to as the "Program").
1.2. The purpose of these General Terms and Conditions is to set the terms of operation of the Program. Anyone applying for membership in the Program is deemed to have read and accept without reservation these Terms and Conditions.

Article 2 - Purpose
The purpose of the Program is to make available to its Members (hereinafter referred to as the "Member") various benefits, services and exclusive offers offered by La Maison du Chocolat.

Article 3 - Membership conditions
3.1. Membership is open to all individuals over the age of 18. It is not possible to open a loyalty account in the name of a legal entity (company, professional organization, association, ....). However, certain purchases made by the Member in a professional capacity may be credited to the Member's account (see conditions in article 5.6.).
3.2. Only one membership application per person and per household will be accepted.
3.3. Membership is available in French boutiques (excluding resellers) on request or from a sales consultant, or via the lamaisonduchocolat.com website. Membership is automatic on the website when an account is opened as a "private individual".
3.4. Membership of the Program is unlimited as long as La Maison du Chocolat has not decided to modify or terminate it.
3.5. The La Maison du Chocolat Loyalty Program is valid in all La Maison du Chocolat physical and web boutiques in France, the United States, Hong Kong and Japan. The Loyalty Program is not valid at physical or digital retailers (e.g. corners at Galeries Lafayette, Publicis Drugstore, Extime airport boutiques, etc.).

Article 4 - Change of contact details
Any change of name, address or any indication that may be necessary for the running of the Program must be notified as soon as possible:

Article 5 - Acquisition of loyalty points
5.1. With each purchase, the Member accumulates loyalty points according to the following scale: 1 point = 2 euros (inclusive of VAT). Purchases are recorded and accumulated on the account Member within 24 (twenty four) hours in all La Maison du Chocolat stores participating in the Program, as well as on the online store if  that the Member has linked his loyalty card number to his Internet account.
5.2. For the Member who has opened a card in store, for his online order to be linked to his Loyalty account, he must first open an account on the website using the email address given in store when joining. Because it is thanks to the email address that he will be recognized and that his loyalty account number will be associated with his Web account.
5.3. The accumulation of loyalty points is triggered from the date of joining the program. With each purchase, the Member starts again a cycle of one year of validity of its points. Previously accumulated and newly acquired points are added and all are valid for one year. The maximum number of points is 1200. The Member who has reached this amount will have to redeem his points, in order to be able to accumulate loyalty points again.
5.4. If the Member does not make purchases within 12 (twelve) months, his point balance will be reset automatically. An email will be sent 30 days before the expiry date of the points if the customer has accepted to receive communications by email from La Maison du Chocolat.
5.5. The balance of points loyalty is indicated on the receipt given with each purchase, on the online store lamaisonduchocolat.com/en_fr, in the space "My account "and in communications sent to Members.
5.6. Business purchases made by the Member may be credited to his Carré des Passionnés account and thus give rise to loyalty points up to a maximum of € 1,000 (inclusive of VAT) per order.
5.7. The advantages of the La Maison du Chocolat loyalty card can not be combined with other loyalty cards (My Paris Airport, Printania). The Member will have to choose on which card he wishes to register his purchase.

Article 6 - Redeem Gifts
6.1. The gifts are withdrawable on the online store lamaisonduchocolat.com/en_fr and in the La Maison du Chocolat boutiques with the exception of shops located in airports, Department Stores and Publicis Drugstore.
6.2. Starting from 50 loyalty points, the Member can redeem points for a gift. The Member will have to choose among the gift proposals presented. No other gift can be given to him. The Member may choose one or more gifts within the limit of his points balance.
6.3. The list of proposed gifts can be modified at any time by La Maison du Chocolat.
6.4. The loyalty points can not be sold or exchanged for cash.

 

Article 7 - Other Benefits
7.1. The Member benefits from advantages on deliveries in Metropolitan France and Europe. The details of the advantages are described on the loyalty program presentation page.
7.2. On the day of his birthday, the Member will receive a special offer by email, subject to having agreed to receive communications from La Maison du Chocolat by email.
7.3. Twice a year, at a time defined by La Maison du Chocolat, the Member's loyalty points will be doubled for each purchase made during the defined week.

Article 8 - Use of the loyalty card in foreign shops
When the Member makes a purchase in a La Maison du Chocolat shop located in another country, the purchase made by the Member will automatically be credited on his account, provided that the Member has submitted his loyalty card, and the calculation of points will be made according to the country rule (1 loyalty point for $ 4 to USA, HKD50 in Hong Kong and 550 Yen in Japan).

 

Article 9 - Deactivation and exclusion of Members
9.1. Deactivation: The Maison du Chocolat reserves the right to close an account without movement for a minimum of one year. The Member may, however,request a reopening of his account during a purchase, if he wishes to become part of the Program again.
9.2. Exclusion: La Maison du Chocolat reserves the right to exclude from the Program any Member that does not comply with these General Conditions or who allegedly misused the benefits, services or exclusive offers. Radiation induces the immediate loss of all benefits of membership. The excluded Member will not be able to apply again for membership. And his exclusion will not give rise to any compensation or indemnity.

Article 10 - Modification and termination of the Program
10.1. La Maison du Chocolat reserves the right to modify the Program at any time without notice. These changes will be communicated to the Member by any means within a reasonable time. In case of refusal of these modifications, the Member is free to terminate his membership under the conditions provided by Article 11 below.
10.2. La Maison du Chocolat is entitled to terminate the Program at any time by giving 3 (three) months notice. In the case of a definitive cessation of program, the Member will be informed by mail and will not be able to exercise any recourse against La Maison du Chocolat for any reason that it is. The Member then benefits from a period of 3 (three) months from the notification of the end of the program to continue accumulating points
fidelity and exchange them for the corresponding gift. No request will be admissible at the end of this period.

Article 11 - Termination by the Member
The Member may terminate its membership in the Program at any time. In this case, he will have to send a mail to La Maison du Chocolat - Service Carré des Passionnés - 41 rue Paul Lescop - 92000 Nanterre - FRANCE or by mail to client@lamaisonduchocolat.fr. Membership will be terminated immediately. Member can not claim any compensation or compensation.

Article 12 - Liability
12.1 La Maison du Chocolat can not be held responsible in the event of delay, loss, or bad distribution of the mail or its sending to an address wrongly, telephone and Internet connection problems, delaying or preventing the fulfillment of the obligations for which it is responsible under Program.
12.2. Although La Maison du Chocolat has ensured that all the information provided by the Member or the Member is correct, La Maison du Chocolat can not be held responsible for errors in the content of the information or their possible consequences.
12.3. La Maison du Chocolat can not be held responsible in case of unavailability of the benefits, services and exclusive offers.

Article 13 - Applicable law
These general conditions are governed by the French law with the exception of any other. Any dispute that can not be resolved amicably will be before the competent court according to the provisions of the common law in this matter.

Article 14 - Data Protection

La Maison du Chocolat pays particular attention to respecting your personal data, for more details please refer to our privacy policy. The personal data requested from you are necessary to allow our Members to benefit from the advantages, services or exclusive offers. They are intended for La Maison du Chocolat, SAS with share capital of €13,222,470, whose head office is located at 65 avenue de Ségur, 75007 Paris, FRANCE, registered with the RCS of Paris under number 572 154 318, responsible for processing and are based on the consent of the Members. They may be communicated, for these same purposes, to the marketing department as well as to subcontractors and service providers of La Maison du Chocolat. This data may be transferred outside the European Union to:

the United States;
Japan;
China;
Macao;
South Korea;
Kuwait.
Each of these transfers is governed by legal instruments that comply with the applicable legal framework.

They are kept for a period of 4 years from the date of the member's membership, the date of their last purchase or the last Newsletter opened and used.

You have the right to access, rectify, erase, oppose, and have the right to the portability of information concerning you, as well as the right to limit the processing that you can exercise by sending an email to mesdonneespersonnelles@lamaisonduchocolat.com or by sending a letter, specifying your contact details (identity, proof to attest to your identity), to La Maison du Chocolat, customer service, 41 rue Paul Lescop, 92000 Nanterre.

You also have the right to define general and specific guidelines defining how you intend these rights to be exercised after your death.

You have the right to lodge a complaint with the CNIL, the supervisory authority responsible for compliance with personal data obligations.

You are informed that if you do not wish to be the subject of commercial prospecting by telephone, you have the right to object to telephone canvassing by entering your landline and/or mobile phone numbers on the free opposition list accessible via the website www.bloctel.gouv.fr.

You are informed that your request will be effectively processed within 30 days of confirmation of your registration. This registration is valid for a period of 3 years.
